1. Acceptance of Terms

By purchasing or using any product from Merryman 3DP L.L.C. (“the Company”), the purchaser (“the User”) acknowledges that they have read, understood, and agreed to these Terms and Conditions in full.

2. Intended Use & Compatibility

Products are designed and manufactured for lawful recreational hunting-related and outdoor uses that do not involve firearms. The User is solely responsible for ensuring each product is compatible with any other equipment, accessories, or systems before use. Use with incompatible equipment may cause damage or injury.

3. Assumption of Risk

By purchasing or using any product, the User voluntarily assumes all risks associated with its use, including but not limited to property damage, personal injury, or death that may result from normal use, improper use, wear, environmental conditions, or unforeseeable failure.

4. Product Use, Modification & Installation

The Company is not responsible for injuries, damage, or loss resulting from:
- Modification or alteration of any product;
- Installation or use by unqualified persons;
- Use with equipment or accessories not specifically recommended by the Company; or
- Negligent handling, repair, or misuse.

Any modification or use contrary to manufacturer instructions voids all warranties and releases the Company from liability.

5. Limitation of Liability

To the maximum extent permitted by Michigan law, Merryman 3DP L.L.C. shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or related to the use or inability to use any product. In no event shall the Company’s total liability exceed the purchase price paid for the product.

6. Disclaimer of Warranties

All products are provided “as is” and without any warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or durability. The User is responsible for determining whether a product is suitable for their intended use.

7. Indemnification

The User agrees to indemnify, defend, and hold harmless Merryman 3DP L.L.C., its members, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorney fees) arising from the User’s use, misuse, modification, or negligent handling of any product.

8. Governing Law & Venue

These Terms are governed by and construed in accordance with the laws of the State of Michigan. Any dispute shall be litigated exclusively in the state or federal courts located in Kent County, Michigan.

9. Severability & Changes

If any provision is held invalid, the remaining provisions remain in effect. The Company may modify these Terms at any time; continued purchase or use after notice constitutes acceptance.
